This is a translation; only the German version is legally binding.

1. Scope

MeLocaly is offered by Bambu Games Yazılım Sanayi ve Ticaret A.Ş., Altınşehir Mah. Muammer Aksoy Cad. Bina No:79 Neva Suite No:84, 16230 Nilüfer/Bursa, Türkiye (“we”). These terms apply to guests who use the MeLocaly app and a MeLocaly account. Separate agreements apply to venues.

By signing up you agree to these terms. Our privacy policy explains how we process your data.

2. Services

MeLocaly is an app for guests of cafés, restaurants, bars, lounges and shisha bars. With it you can in particular:

  • discover venues and view their menus;
  • order rounds at the table by QR code and ask for the bill;
  • collect points, redeem rewards and use the venues’ offers;
  • request reservations;
  • review venues and products.

Using MeLocaly is free for guests. You pay at the venue; the app handles no payments. Each venue decides which features it offers. We keep developing MeLocaly and may change features as far as this is reasonable for you.

3. Account

  • You must be at least 16 years old.
  • Your details must be true; each person may have only one account. The account cannot be transferred.
  • Keep your password secret and tell us if you suspect misuse of your account.

4. Contracts with venues

Orders, reservations and payments are made solely between you and the venue; we are not a party to them. The venue is responsible for its menus, prices, allergen information, opening hours, offers, rewards and services.

An order in the app is an offer to the venue, which it can accept or decline. A reservation stands only once the venue confirms it. If you do not show up for a confirmed reservation, the venue can record this; please cancel reservations you will not keep in the app.

5. Points and rewards

  • Points are valid only at the venue where you collected them and only for its rewards.
  • Points have no cash value, are not paid out and cannot be transferred.
  • The venue decides how many points it gives and which rewards it offers; it can change its rules.
  • If you delete your account, or disconnect from a venue and have your data deleted, the points concerned lapse.
  • In case of misuse, for example manipulated QR codes, the venue or we can withdraw points.

6. Reviews and content

Reviews must be based on your own experience from a visit. We do not tolerate objectionable content. In particular, the following is not allowed:

  • insults, threats, harassment and hate speech;
  • discrimination, depictions of violence and sexual or pornographic content;
  • false statements of fact and fake or bought reviews, including for venues you have business ties with;
  • advertising and spam;
  • other people’s personal data, such as staff names, phone numbers or photos of recognisable people without their consent;
  • content that infringes the rights of others (e.g. copyright) or the law.

You grant us a free, non-exclusive right to show your reviews (text and photo) in MeLocaly and to process them technically for this (e.g. image size). The right ends when you delete the review or your account. Venues can reply to reviews publicly.

7. Reporting, blocking and moderation

Through a review’s menu you can report it or block the person; you then no longer see their reviews. You can lift blocks in your profile. You can also report unlawful content by email to [email protected].

An automatic filter turns down texts with offensive words. The MeLocaly team reviews reports, usually within 24 hours. If content breaks these terms or the law, we hide it; for serious or repeated breaches we suspend the account. Venues can ask us to review a review; we make the decision.

If your content or account is affected, we tell you the decision and its reasons. You can object at [email protected]; we will then review it again.

8. Prohibited use

You must not misuse MeLocaly; in particular, do not manipulate QR codes to obtain points, rewards or orders, do not read the app or our servers automatically and do not get around security measures.

9. Availability

We aim for smooth operation but cannot promise uninterrupted availability. Maintenance and technical faults can limit use for a time.

10. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act.

For slight negligence we are liable only for breaches of essential duties, meaning duties whose fulfilment makes using MeLocaly possible in the first place and on which you may rely, and only up to the foreseeable, typical damage.

We are not liable for the venues’ services or for other users’ content; our duty to remove unlawful content once we know of it remains unaffected.

11. Term and termination

You can delete your account in the app at any time and so end the contract of use. We can terminate the contract with four weeks’ notice. The right to terminate without notice for good cause is unaffected; good cause includes, in particular, serious or repeated breaches of these terms.

12. Changes

We can change these terms for the future if MeLocaly or the law changes. We tell you about changes at least four weeks in advance in the app or by email. If you do not object before they take effect, the changes count as accepted; we point this out in the notice. If you object, we can terminate the contract as of the date the changes take effect.

13. Final provisions

German law applies. If you are a consumer, the mandatory consumer protection rules of the country where you habitually live remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If individual provisions are invalid, the rest remain valid.
